The Dreamtime community is a service of The Dreamtime (a company doing business in the State of Indiana). Any and all references to The Dreamtime community also apply to The Dreamtime, the business.

The Dreamtime community is a service for adults (except for friends/pen pals which may be used by those under the age of 18). As part of this service, you agree to the terms of the Agreement below. Please read the Agreement carefully. IF YOU CHOOSE NOT TO ACCEPT THE TERMS OF THIS AGREEMENT, YOU MAY TERMINATE YOUR PARTICIPATION IMMEDIATELY BEFORE USING THE SERVICE. Most important, you act as the publisher of your own content and you are solely responsible for the information you post and for your interaction with other users of this service.

Either you or The Dreamtime may terminate your membership in the service for any reason.

By registering and participating in The Dreamtime community, you agree to abide by the following rules:

• You will treat Emails and other information as private and will not forward that information without permission of the originator of the information.
• You will not harass others or use any vulgar, racist, or otherwise offensive language, either in public posted material or in private emails sent to other The Dreamtime community members. You will not include in your profile any anatomical or sexual references or sexually suggestive and connotative language.
• You will not post any telephone numbers, street addresses, last names, and/or email addresses in your profile.
• You hereby grant The Dreamtime community the right to give out your Email address and First Name to others who are members of The Dreamtime community for community matching purposes.
• The Dreamtime community reserves the right to edit photo submissions. Nudity and personal information in photos are unacceptable.
• You will not post advertisements or forward chain letters.
• You will not use any service provided by The Dreamtime community to libel, defame, or slander any person, and you will not use any service provided by The Dreamtime community to infringe the privacy rights of any person.
• You will not post any information that infringes the property rights of any person, including but not limited to the intellectual property rights of any person.
• You assume full responsibility for all charges from other providers incurred in accessing The Dreamtime community service (such as online access providers, telephone service providers, or others).

The Dreamtime community does not:

• Verify any information posted to the service or guarantee the proper use of such information by any party.
• Review or assume any responsibility for the content of private email messages sent between Members using Members Email addresses or using our anonymous remailer. We do not ensure that these messages may not contain material that could be offensive to some.
• Monitor or resolve disputes between service subscribers.
• Ensure that offensive material will be promptly removed from the service.
• Ensure secure transmissions over the Internet.

The Dreamtime community service contains proprietary information of The Dreamtime community and its licensors. In addition, other persons may post copyrighted information, which has copyright protection whether or not it is identified as copyrighted. Except for that information which is in the public domain or for which you have been given permission, you will not copy, modify, distribute, or sell any such information.

YOU AND OTHER PROVIDERS OF INFORMATION ARE THE PUBLISHERS OF THE INFORMATION CONTAINED ON The Dreamtime community. The Dreamtime community IS NOT A PUBLISHER OF SUCH INFORMATION. IN NO EVENT WILL The Dreamtime community BE RESPONSIBLE FOR ANY INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHER DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING ANY INTERRUPTIONS OF SERVICE, VIRUSES, POWER OUTAGES, OR COMMUNICATIONS BY OTHER SERVICE USERS.

WARNING - PLEASE READ THIS: It is possible that other The Dreamtime community Members or users (including unauthorized users, or "hackers") may post or transmit offensive or obscene materials on The Dreamtime community service and that you may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about you due to your use of the Service, and that the recipient may use such information to harass or injure you. The Dreamtime community is not responsible for the use of any personal information that you may choose to disclose on the Service. Please carefully select the type of information that you post on The Dreamtime community service or release to others.

The Dreamtime community may choose to monitor the public areas of the service in accordance with any legal requirement, in order to maintain the service, and to protect the rights of service users.

You agree, at the request of The Dreamtime community, to defend, indemnify, and hold harmless The Dreamtime community, its officers, directors, employees, agents, and third parties, from your use of the service, including any violation of the rules contained in this Agreement or any accusation that the information that you post infringes the intellectual property rights (such as copyright, trade secret, trademark, or patent) of any third party or that such information disparages, libels or invades the privacy of any third party.

LIMITATION OF LIABILITY:
IN NO EVENT WILL The Dreamtime community (i) BE LIABLE TO YOU FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF DATA, LOSS OF PROGRAMS, COST OF PROCUREMENT OF SUBSTITUTE SERVICES OR SERVICE INTERRUPTIONS) ARISING OUT OF THE USE OF OR INABILITY TO USE The Dreamtime community SERVICE, EVEN IF The Dreamtime community OR ITS AGENTS OR REPRESENTATIVES KNOW OR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR (ii) TO ANY PERSON OTHER THAN YOU. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, The Dreamtime community's LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO The Dreamtime community FOR THE SERVICE DURING THE TERM OF MEMBERSHIP. IN ADDITION, The Dreamtime community DISCLAIMS ALL LIABILITY, REGARDLESS OF THE FORM OF ACTION, FOR THE ACTS OR OMISSIONS OF OTHER MEMBERS OR USERS (INCLUDING UNAUTHORIZED USERS, OR "HACKERS") OF The Dreamtime community SERVICE.

The Dreamtime community PROVIDES THE SERVICE ON AN "AS-IS" BASIS WITHOUT WARRANTY OF ANY KIND, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Certain jurisdictions limit the applicability of warranty disclaimers and limitations of liability so the above disclaimers of warranty and liability may not apply to you.

This Agreement is entered into in South Bend, Indiana. You agree that Indiana law (regardless of conflicts of law principles) shall govern this Agreement, and that any dispute arising out of or relating to this Agreement shall be subject to the federal and state courts in South Bend, Indiana. Unless otherwise explicitly stated, the Terms will survive termination of your membership to the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
